While less common in Canada than in the United States, HOAs do exist here\u2014and they can wield significant power over your property and your peace of mind.<\/p>\n\n\n\n<p>Although HOAs seem less problematic here, understanding what an HOA does, what legal authority it has, and how its rules can affect you is essential for any owner. Because when things go wrong, they can go very wrong.<\/p>\n\n\n\n<p><strong>What Is an HOA?<\/strong><\/p>\n\n\n\n<p>A Homeowners&#8217; Association is a legal entity typically created by a developer when a subdivision or planned community is built. They are governed by a board of directors elected by the members (the homeowners), and they operate under a set of governing documents that typically include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Articles of Incorporation<\/strong>: The founding document that establishes the HOA.<\/li>\n\n\n\n<li><strong>By-Laws<\/strong>: Rules governing how the HOA operates, including meetings, elections, and board powers.<\/li>\n\n\n\n<li><strong>Covenants, Conditions, and Restrictions (CC&amp;Rs)<\/strong>: Legally binding rules that run with the land\u2014meaning they apply to all current and future owners, regardless of when they bought.<\/li>\n<\/ul>\n\n\n\n<p><strong>What Legal Powers Does an HOA Have?<\/strong><\/p>\n\n\n\n<p>HOAs derive their authority from the legal documents registered on title to your property. When you purchased your home, you effectively agreed to be bound by these rules, whether you read them carefully or not.<\/p>\n\n\n\n<p>Depending on the governing documents, an HOA may have the power to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Impose and collect fees<\/strong>: HOAs typically charge monthly or annual fees to cover maintenance and operating costs.
